I’m a Motorcyclist Who Has Been Rear-ended By A Car in Virginia Beach : What Do I Do?

Q:  What am I to do if I’m a motorcyclist who was rear-ended by a car?  The car hit me from behind as I was waiting for the stoplight at the intersection of Independence Blvd. and Virginia Beach Blvd.  I did sustain serious injuries and I’ve been recovering in Virginia Beach General Hospital.

A:  According to the Virginia Model Jury Instructions, which are the laws a Virginia Beach judge would give the jury, “If the [motorcyclist’s] vehicle was lawfully stopped in its lane of travel and was struck from the rear, you may find that [the defendant] was negligent unless the jury believes from other evidence that [the defendant] was not negligent.”  In most rear-end crash situations, the driver of the motor vehicle which was stopped and struck from behind, is not at fault.
